Bankruptcy

Bankruptcy is a legal means to reorganize your debts. A bankruptcy can help you catch up on your mortgage, car payments, IRS debt and past due child support. If you cannot afford to repay your unsecured debts (usually credit cards) these debts will be discharged. You will not need to make payments on your discharged debts. Bankruptcy is designed to give you a financial fresh start. When you complete your bankruptcy case, you will be current on your mortgage and other secured debts and the dischargeable unsecured debts will be wiped away. If it is not possible for you to catch up your secured debts (usually a mortgage) you can return the collateral to the lender without paying a deficiency. A bankruptcy will stay on your credit for 7 to 10 years. Because the bankruptcy fresh start is so powerful, many of our clients notice that their credit scores are higher after completing a bankruptcy.

  • Chapter 7


    A person who resides in the United States may file for bankruptcy in a federal court under Chapter 7. In a Chapter 7 bankruptcy, you may be allowed to keep certain exempt property. Most liens (such as car loans, security interests and real estate mortgages), survive.

  • Chapter 13


    Chapter 13 is a way to income-receiving debtors a debtor rehabilitation provided they fulfill a court-approved plan. This is a bit different from Chapter 7, which offers immediate and full relief of many overwhelming debts. Chapter 13 is a form of debt consolidation.

Credit Card Defense

Credit Card Defense is the term we use when a client is being sued by a credit card company and would like to defend the lawsuit in court or negotiate a settlement with the creditor. If you are being sued by a credit card company (or any creditor), it is important that you call us right away. Your court date may be approaching and we need to file a response quickly to effectively defend against the lawsuit.

Creditor Harassment

is the term we use when a client is being harassed by one of their creditors. Creditor harassment may include incessant phone calls, illegal threats or foul language. Basically, creditor harassment occurs when your creditors do not treat you with respect or dignity.
